Sales Terms and Conditions

We require our website Users to read carefully and agree upon our Sale terms and conditions as well as our Privacy Policy and Disclaimer hereby set out. Any transaction through this website shall automatically mean the User has accepted our Sales terms and conditions, Privacy Policy and Disclaimer .

These terms and conditions consist of a legal agreement for the use of our website and the services we offer, including the sale of retail goods to consumers. We strongly recommend that Users also access and read any other information contained on other pages or any referred websites, as they may contain further applicable terms and conditions.

1. New Customer

1.1   Users can browse our website without registration. However, personal information such as name, address, phone number, email address, etc. shall be provided in order to purchase any goods via our website.

2. Products Description and Information

2.1   All products displayed on this website are available only whilst stocks last. Every effort has been made to reflect product colors as accurately as possible. However, due to factors such as differences in monitors and screen settings, we are unable to guarantee that the color you will see on your monitor will accurately reflect the true color of the product.

2.2   All drawings, photos, descriptive matter, specifications and advertising issued on this website and any descriptions, photos or illustrations contained in Christian Denhez’s ltd. catalogues or brochures are issued or published for the sole purpose of giving an approximate idea of the products described in them. They will not form part of the agreement with User and no warranty or guarantee shall be expressed or implied in this regard.

3. Purchasing Products

3.1   Prices on this site are calculated in Thai Bath (included Thai VAT (7%). All others currencies displayed are for your convenience and are approximations only. We accept Visa, MasterCard, and Amex, through PayPal. Payments are taken securely online at the checkout stage.

3.2   Successful orders will be followed up with an order confirmation email to the supplied address showing receipt of purchases. An order confirmation acknowledges that the User order has been received but does not confirm acceptance of the order by us. Acceptance will take place upon dispatch subject to card validation and authorization checks by PayPal or similar company and to stock availability.

3.3   We will from time to time apply reductions against normal prices of selected goods and/or their shipping costs. We may do this by applying promotional codes to the listings of those goods on the website, in which case the deductions will be labeled on the site and applied automatically at the check-out stage of the User purchase transaction.

3.4   Customs taxes are normally included in the freight. When products are delivered outside Asia, the User shall however be responsible for paying any local sales tax or import duties arising at the delivery destination, which are not included in the price of the products.

3.5   Prices are quoted exclusive of postage and packaging, which will be charged at the rates specified during the checkout process depending on the weight and freight destination. Total price to settle will be mentioned in the basket during checkout process.

3.6   Products are normally delivered in 3/5 days in Thailand, 10 days outside Thailand. In case of delay in the supply of products, we will advise the User as soon as practicable. However, if the products cannot be delivered within 30 days upon order, we will notify the User of such delay and the user may either cancel its order or agree a further delivery time with us.

3.7   Any order placed with us will not be accepted and no agreement will be formed until the User has been instructed that said goods are available and these goods have been paid for and all applicable charges paid in full. No payment shall be deemed to have been received until we have received payment in cleared funds. We will confirm our acceptance of the User’s order upon receipt of cleared funds by email (where a valid email address is provided). We reserve the right at all times and at our sole discretion to refuse to accept any orders. If the User exercises a right to cancel its order but the goods have already been dispatched, please follow the Returns Procedure set out below (Returns and Exchanges).

3.8   Christian Denhez Ltd. will cancel an e-voucher if we fail to receive payment from the purchaser's bank or Card Company for the initial purchase of the card. We may take further action when we suspect any fraudulent use or attempted use of the e-voucher. Christian Denhez Ltd. reserves the right to refuse an e-voucher in payment or part payment for any item in case of reasonable suspicion that the e-voucher might have been stolen or otherwise misappropriated.

4. Delivery

4.1   We use international express freight companies for delivery with tracking number such as FEDEX, DHL or UPS and EMS for Thailand. Delivery times are subject to stock availability and to possible delays due to credit card authorization, compliance with customs controls and other factors outside our control.

4.2   We will ship our products to countries as listed in our website shipping list and will not honor orders requiring delivery to any destination outside the listed countries. If your country is however not listed, please send an email to [email protected] and we will confirm whether we can exceptionally ship the products. Please note that we do not ship to PO Boxes.

4.3   We will take all reasonable steps to deliver goods within 10 days upon order, unless we have agreed a longer period with the User. All deliveries require a signature. Accordingly, please ensure that someone is in to sign for the goods. If you are not in to receive goods, you can contact the courier to arrange a new delivery time. You also have the opportunity to add any special delivery instructions during the ordering process. However, we can take no responsibility for any delivery problems arising from incomplete or incorrect address details supplied by the User.

4.4   If the User prevents delivery of the goods by, (for example) failing to supply the courier or its local customs, tax office with necessary information or documentation, or failing to pay local customs, taxes or courier’s administration fees so its package is returned to Christian Denhez Ltd., any resulting return postage or courier’s administration fees incurred will be deducted from the amount refunded to the User in respect of that order.

5. Returns and Exchanges

5.1   We will offer an exchange (if stock available) or refund if not on any unworn/unused goods (faulty or otherwise) within 15 days upon dispatch. The User shall return the goods to us in or with their original packaging with their labels intact and our anti-robbery (if any). The date your items were dispatched by us will be detailed in the documentation that arrives with your order. You will receive a returns form by e-mail for you to complete and return with the goods.

5.2   If any item returned by the User is not due to our default, the User shall bear the freight cost. The User shall also pay the freight cost in case of exchange.

5.3   If any item returned by the User is due to our fault, we then agree to bear the freight cost. If the User requires an exchange in such case, we will provide a replacement provided we have stock available, and the User will not be charged again for delivery of the replacement item.

5.4   Refunds must be made following the Returns procedure documented on the “Returns Form” which will be sent to the User by e-mail. Please note that the User has a legal obligation to take reasonable care of the items while they are in its possession, and if the User fails to do so we may have a right to make a claim against the User for compensation. We therefore recommend that the User wrap its items safely and securely to avoid any damage during transit back to us. The User shall include completed "Returns Form" and send its package back to Christian Denhez Ltd. office. The User shall use the services of the same freight company for deliver.

5.5   If refund is required, it will be made in the same way as the original payment method (such as gift voucher, debit/credit card account, etc.).

6. Acceptable Use

6.1   Whenever the User makes use of a feature that allows him/her to upload material to our site, or to make contact with other users of our site, the User must strictly comply with the content standards set out in our Disclaimer and Privacy Policy . The User warrants that any such contribution complies with those standards and agrees to indemnify us for any breach of that warranty.

6.2   We will not be responsible to any third party for the content or accuracy of any materials posted by the User or any other user of our site. We have the right to remove any material or posting made on our site if, in our opinion, such material does not comply with the content standards set out in our Disclaimer and Privacy Policy .

6.3   In the event that User breaches any of these conditions, the latter shall indemnify and keep indemnified Christian Denhez Ltd., its parent, subsidiaries and/or associated companies, employees, agents, professional advisors, suppliers and/or affiliates against all damages, losses, claims, costs, charges, awards, orders, judgments and other liabilities suffered or threatened as a result of a breach of these conditions.

7. Limitation of Liability

7.1   We will not be liable for any loss of revenue, loss of profit, loss of contract, loss of business or any anticipated savings, loss of goodwill or reputation, or any special, indirect or consequential damages arising out of or in connection with these Sales Terms and Conditions.

7.2   We have no liability of any sort (including for negligence) for the acts or omissions of other providers of telecommunications services or for faults in or failures of their networks and equipment.

7.3   We provide links to other sites and resources provided by third parties only as a convenience to our User. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from use of such sites. No mention of any organization, company or individual, whether on these pages or on other websites to which these pages are linked shall imply any approval or warranty by us as to the standing and capability of such organizations, companies or individuals.

8. Indemnity

The User agrees to indemnify and hold us and our affiliates and/or agents as well as our and their respective officers, directors and employees harmless from any claim or demand, including legal fees, made by any third party due to or arising out of the User breach of these Sales Terms and Conditions or the User violation of any law or rights of a third party.

9. Trade Marks and Copyright

All content included on this website (including, without limitation, the trademarks of Christian Denhez, logos, graphics, text, photos, designs, logos, icons, images, data and software) is the property of Christian Denhez Ltd. for which the User must strictly comply with the content standards set out in our Disclaimer and Privacy Policy .

10. Termination and Suspension

We may immediately issue a warning, suspend or terminate the User registration and deny the latter access to all or part of the website or refuse to provide our services without notice if:

  • The User is in breach of any part of these Sales Terms and Conditions;
  • We cannot, for any reason, verify or authenticate any information provided to us;
  • We believe that the User actions may cause legal liability for us or any other user.

11. Notices

11.1 Any notice, which we are required to give to the User regarding the services, may be sent by e-mail or first class-post to the address provided by the User on registration (or as amended from time to time).

11.3 Notices sent by e-mail are deemed to be received 24 hours after an e-mail is sent unless we receive a notice that the e-mail address is invalid. Registered mail and first class-post will be deemed received 3 / 5 days following the date of mailing.

12. Governing Law

       These Sales Terms and Conditions, contracts for the purchase of products made via our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of kingdom of Thailand and the User agrees that Thai courts will have exclusive jurisdiction for any related dispute.

13. General

13.1 These Sales Terms and Conditions set out the entire understanding and agreement between us and Users.

13.2 We may amend our Sales Terms and Conditions at any time by posting an amendment on our website. Any amendment will govern new User registrations from the date that it is posted and existing Users will be bound by the amendment after the expiry of 14 days following the date of posting.

13.3 Nothing in these Sales Terms and Conditions shall create or be construed to imply any agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship between Users and us. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of the provisions to which they relate.

13.4 If any provision of this agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in full force and effect.

13.5 Our failure to act with respect to a breach by Users or others shall not be considered as a waiver of our right to act with respect to subsequent or similar breaches.
